| 4/07/08: 89 DEATH ROW CONVICTS ENTERES ITS FOURTH DAY |
mespace prefix = o ns = "urn:schemas-microsoft-com:office:office" /> The hunger strike by 89 death row convicts entered its fourth day today at the Malindi GK prison as the Judiciary and the prison authorities each shifted responsibility to the other. The matter has even been complicated by the sudden transfer of the newly posted Resident Judge, Lady Justice Wanjiru Karanja, who reported at the Malindi Law Courts yesterday but has already been transferred to another station.Lady Justice Karanja visited the prisoners yesterday and promised to address their grievances, but it is not clear what her urgent departure means for the death row convicts. The convicts situation is further compounded by the fact that lawyers serving in the High Court in Malindi have been on strike since July last year. While the Judiciary says the issue was supposed to be handled by the Prison authorities, the officer in charge of the Malindi GK Prison told journalists yesterday that it was an issue to be handled by the courts. The prisoners, who are protesting the delay in the hearing of their appeal cases, staged a hunger strike on Saturday last week and have vowed to continue until the Chief Justice convenes a two-bench court to hear their appeals which they claim have taken long to be heard.82 of the convicts were transferred from the Shimo la Tewa maximum prison on Thursday last week while seven were already in Malindi.Senior Principal Magistrate Beatrice Thuranira Jaden, who is also the Deputy Registrar of the High Court in charge of the North Coast Region, said she could not comment on a matter being handled by the judge. You may have to wait till the new judge reports in a week's time,Mrs. Jaden told journalists, Since it is an issue that emanated from the prison and there is a list of grievances from there, why don't you get a comment from the officer in charge of the prison?"However, the officer in charge of the prison, Mr. B. M. Mutunga, said the prisoners were guests of the High Court in Malindi and only the Judiciary could comment. The prisoners, according to the sources, want Chief Justice Evan Gicheru to personally take up the matter and ensure they get justice.
